So i received my kickstarter kit and am bench testing hardware before assembling.

I am having an issue with the power switch. Supposedly it is a momentary switch, but i have the physically hold it in order to keep the pi zero powered up. if i let go, it kills the power to the pi immediately. 

is this a hardware issue? i am using the standard retropie IMG and it works fine otherwise.

Yes. You should be using our image, or else you would need to add to some features to the stock RetroPie Image.
